Jack Kamysz, 64, of Roselle allegedly head-butted a Metra train conductor.

Charges have been filed against Jack Kamysz, 64, of 22W118 Irving Park Road, Roselle for allegedly Head-butting a Metra Conductor after failing to pay his fare. Kamysz appeared in Bond Court this morning where Judge Richard Russo set bond at $50,000 with 10 percent to apply.

The charges stem from allegations that on July 6, 2015, at approximately 6:54 p.m., Kamysz was traveling on a Metra train as it approached the Bensenville station. The train conductor, John Smak, approached Kamysz and requested his fare. Kamysz responded with vulgarity. As Smak attempted to escort Kamysz to the vestibule of the train, Kamysz head-butted Smak, breaking his nose.

Metra Police removed Kamysz from the train at the Bensenville station.

“The allegations against Mr. Kamysz are outrageous,” Berlin said. “This type of unprovoked attack on a man who was just doing his job will not be tolerated in DuPage County and will be met with the full force of the law.”

“We take safety and security onboard our trains very seriously, and we will arrest and prosecute anyone who assaults one of our riders or employees to the fullest extent possible,” said Metra Deputy Police Chief Carl Anderson.

Kamysz has been charged with one count of Aggravated Battery to a Transit Employee, a Class 3 Felony. His next court appearance is scheduled for August 3, 2015 in front of Judge Liam Brennan.

Members of the public are reminded that this complaint contains only charges and is not proof of the defendant’s guilt.  A defendant is presumed innocent and is entitled to a fair trial in which it is the government’s burden to prove his or her guilt beyond a reasonable doubt.
