Aggravated unlawful use of a weapon

On Aug. 23, patrol officers from the Woodstock Police Department were dispatched to the area of N. Seminary Ave (Rt. 47) and St. Johns Road, in reference to a disturbance, which was called in by a concerned citizen.

Upon the arrival to the area, officers located three subjects who appeared to be engaged in a verbal argument amongst each other. The subjects were subsequently identified as 20-year-old Andres L. Hernandez, 19-year-old Juan Esquivel (both from Harvard, Ill.) and a 17-year-old male juvenile from Woodstock. All three subjects appeared to be heavily under the influence of alcohol.

Upon initial contact, all three subjects were detained as none appeared of legal age to consume alcohol. During the course of this investigation, a loaded handgun was located and removed from the pocket of the 17-year-old juvenile.

Hernandez, Esquivel and the juvenile were taken into custody and transported to the Woodstock Police Department. After conferring with the McHenry County States Attorney’s Office, the juvenile was charged with one count of aggravated unlawful use of a weapon (Class 4 felony) and an additional local ordinance charge of purchase and acceptance of an alcoholic beverage by a minor. The juvenile was subsequently transported to the Kane County Juvenile Justice Center in St. Charles.

Hernandez and Esquivel were charged with purchase and acceptance of an alcoholic beverage by a minor and given a notice to appear with a mandatory court date of Sept. 25, at 8:30 a.m. at the McHenry County Government Center and released from custody.
